Please read through the below Portrait Agreement and let me know of any questions or concerns. By checking the boxes and signing your name below, you agree to the terms and conditions laid out in this Agreement. A copy of the signed agreement will be given to you for your records.
PAYMENT TERMS & SESSION DETAILS
The session fee is due at the time of booking and secures the date for your Session. Session Fee is non-refundable, however, if difficulty arises, we will reschedule one time. Please give 48 hours notice before the scheduled session if you need to reschedule. If the weather causes concern, I am happy to reschedule for another day. Any cost for location usage will be paid for by the Client.
This session fee includes:
- 45 minutes – 2 hour photography session;
- The photographers time and eye for detail;
- Online proofing gallery of a minimum of 20 images, which will be available for viewing within 2 weeks of our session.
RESCHEDULING & CANCELLATION
RESCHEDULING
You agree to notify Emily Photography of the need to reschedule at least forty-eight (48) hours prior to the scheduled shoot.
ILLNESS
If Emily Photography cannot perform due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return any deposit or session fee to the Client but shall have no further liability with respect to the Contract.
CANCELLATION.
You acknowledge that in the event that there is a Cancellation of the shoot Emily Photography will incur expenses and financial loss. Therefore, you agree to notify the Studio of a Cancellation at least 72 hours prior to the expected Cancellation date in order to minimize the Studio’s costs, expenses, and loss of income. Due to the custom assignment and inability of studio to perform other sessions during time reserved for Client, if Studio has received payment for a scheduled Assignment, Client will not be entitled to a refund if he or she cancels the Assignment.
PRINT & PRODUCT ORDERING
Images will be available approximately 14 days after your photo session and will be presented to you in an online gallery format. The gallery is password protected for your privacy, however, you may share the online gallery and password with friends and family members as you see fit. Your gallery will be live for 2 weeks to give you time to place your orders. Additional gallery time can be purchased for $35 per week. Your final proofs will be kept as an archive with the photographer for one year from your session date and will then be permanently deleted.
You acknowledge that you have reviewed Emily Photography’s pricing & collection offerings and are aware of minimum ordering requirements to ensure that Emily Photography can offer the highest quality of service to each client.
All prints and other photographic products are ordered through the studio directly and are guaranteed to be of the highest quality. Payment of your portrait order is due in full when the order is placed through the studio. Once payment in full is received, the studio will place the order with the vendor(s).
Print & Product pricing is guaranteed for 30 days from the date of your gallery being live. Should you place an order after the 30 day period; current pricing will be applied at that time. All pricing is subject to change without notice after the 30 day period.
Sneak peek images will be posted on the blog within 2-3 days of the session.
Due to the custom nature of photography, all sales are final. However, should something not meet your expectations, it is your responsibility to contact the studio within two weeks of receiving your order and I will work to resolve to your satisfaction.
PRINT & REFERRAL CREDITS
Print Credits
If you select a collection that includes a print credit, all print credits must be used within the time that your gallery is live (two weeks). They cannot be applied to re-hosted galleries outside of the two-week live period.
Referral Credits
Referral credits will be credited after the fully paid booking and completion of the referred session. All referral credits will be applied to a future session date (after the date of such referred session) and can only be used towards prints and products orders.
COPYRIGHT INFORMATION
All images remain copyright of Emily Photography and may not be reproduced without written permission of the Photographer. All images are also protected by Federal Copyright Law. Scanned or reproduced images are both illegal and a degradation of the original image quality. The Photographer is the only one who can crop or modify any image produced as a result of this session.
